1. Acceptance of Terms
By accessing and using Swapagogo ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.
2. Description of Service
Swapagogo is a platform that connects homeowners who wish to swap their homes for vacation purposes. The Platform facilitates connections between users but does not own, sell, or rent properties. We are not a party to any swap agreement between users.
3. User Obligations
3.1 Account Requirements
- You must be at least 18 years old to use the Platform
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account
- You must notify us immediately of any unauthorized use of your account
3.2 User Conduct
You agree to:
- Use the Platform only for lawful purposes
- Provide accurate information about your property
- Respect other users and their properties
- Not engage in fraudulent, abusive, or illegal activities
- Not use the Platform to spam, harass, or harm others
- Not attempt to circumvent Platform security measures
4. Property Listings
4.1 Listing Accuracy
You are responsible for ensuring that all information about your property is accurate, complete, and up-to-date. Misleading or false information may result in account suspension or termination.
4.2 Property Ownership
You represent and warrant that you have the legal right to list and swap the property. If you are not the owner, you must have written authorization from the owner.
4.3 Property Condition
You agree to maintain your property in good condition and to provide accurate descriptions of its condition. You are responsible for any damage caused by your property during a swap.
5. Swap Agreements
5.1 User Responsibility
Swapagogo facilitates connections between users but is not a party to swap agreements. All swap arrangements are between users, and Swapagogo is not responsible for the terms, execution, or fulfillment of any swap agreement.
5.2 Dispute Resolution
In the event of a dispute between users, Swapagogo may provide a dispute resolution process. However, Swapagogo is not obligated to resolve disputes and is not liable for any losses arising from disputes between users.
5.3 Dispute Resolution Fund
Swapagogo may maintain a dispute resolution fund to assist with certain disputes. Participation in the fund is subject to separate terms and conditions.
6. Fees and Payments
Swapagogo may charge fees for certain services, including but not limited to dispute resolution fund contributions. All fees will be clearly disclosed before you incur them. Fees are non-refundable unless otherwise stated.
7. Verification
Swapagogo offers identity and property verification services. Verification is optional but recommended. Verified status does not guarantee the accuracy of information or the safety of a swap. You are responsible for conducting your own due diligence.
8. Intellectual Property
The Platform and its content, including but not limited to text, graphics, logos, and software, are the property of Swapagogo or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You grant Swapagogo a non-exclusive, worldwide, royalty-free license to use, reproduce, and display any content you submit to the Platform for the purpose of operating and promoting the Platform.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAPAGOGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Swapagogo is not responsible for:
- The accuracy of property listings or user information
- The safety or condition of properties
- The conduct of users
- Any losses or damages arising from swap agreements
- Any interruptions or errors in the Platform
11. Indemnification
You agree to indemnify and hold harmless Swapagogo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another.
12. Termination
Swapagogo reserves the right to suspend or terminate your account at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
13. Changes to Terms
Swapagogo reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
